You can register: (1) Word marks — your brand name in any font or style; (2) Logo/device marks — your graphic logo or icon; (3) Slogans/taglines — unique catchphrases; (4) Combination marks — name + logo together; (5) Color marks — unique color combinations; (6) 3D shape marks — distinctive product shapes; (7) Sound marks — unique jingles. The mark must be distinctive — capable of identifying your business from others. Generic terms (like 'Best', 'Quality') and descriptive terms for the products themselves cannot be registered.

™ (Trademark symbol): You can use this immediately after filing your trademark application — even before registration is granted. It signals that you are claiming trademark rights on the mark. ® (Registered Trademark symbol): You can only use this after your trademark is fully registered by the IP India office (typically 18–36 months after filing). Yes — and ideally you should file both separately for complete protection. A word mark protects your brand name regardless of font or style. A device/logo mark protects the specific visual design of your logo. Filing both gives you maximum protection — someone who copies your name (in a different design) infringes the word mark, and someone who copies your logo (with a different name) infringes the device mark. The trademark examiner may raise objections in the examination report — typically citing conflict with an existing similar trademark or claiming the mark is descriptive. After your trademark is accepted, it is published in the official Trademark Journal for 4 months. During this period, any third party who believes your trademark conflicts with theirs can file an opposition. If opposed, both parties submit evidence and the Registrar decides. A trademark registration is valid for 10 years from the filing date. It can be renewed indefinitely for another 10 years each time by paying the renewal fee before expiry (typically 6–12 months before expiry). If you miss the renewal, there is a 6-month grace period with a surcharge. A lapsed trademark can be restored within 1 year of expiry.
